Welcome to Arkkeus. These Terms of Service ("Terms") govern your access to and use of the Arkkeus website and any games, software, or services we make available (together, the "Services"). By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.

1. Who we are

Arkkeus is an independent game studio based in Italy ("Arkkeus", "we", "us", "our").

2. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your country, you must have your parent or legal guardian's permission to use the Services, and they must agree to these Terms on your behalf.

3. Your licence to use our games

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and play our games for your own non-commercial entertainment. You do not own the games — you are licensed to use them. All rights not expressly granted are reserved.

4. Accounts

Some games or features may require an account. You are responsible for keeping your login credentials safe and for all activity on your account. Please provide accurate information when registering and keep it up to date. You must notify us promptly if you suspect unauthorised access.

5. Purchases

Our games may be sold through third-party platforms (such as Steam, itch.io, the App Store, Google Play, or PlayStation/Xbox/Nintendo storefronts). Your purchase is governed by that platform's terms and refund policy in addition to these Terms. Some games may offer optional in-game purchases or contain advertising; these are clearly indicated before purchase or download.

For purchases made directly from us, EU consumers have a statutory 14-day right of withdrawal for digital content. By starting to download or stream digital content, you expressly acknowledge that you lose this right of withdrawal once delivery has begun.

6. Acceptable use

You agree not to: (a) reverse-engineer, decompile, or tamper with our games except where the law allows it; (b) cheat, exploit bugs for unfair advantage, or use unauthorised third-party software; (c) harass, abuse, or harm other players; (d) use the Services for any illegal purpose or in violation of these Terms. We may suspend or terminate access for violations.

7. Intellectual property

All content in the Services — including code, art, music, text, characters, and the Arkkeus name and logo — is owned by Arkkeus or our licensors and is protected by copyright, trademark, and other laws. You may not copy, distribute, or create derivative works from our content without our written permission, except as allowed by law.

8. Third-party services

The Services may rely on third-party platforms, payment processors, or ad networks. We are not responsible for their content, products, or practices. Your use of those services is governed by their terms.

9. Disclaimer — services provided "as is"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOU USE THE SERVICES AT YOUR OWN RISK.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKKEUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE THAT GAVE RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR EUR 50, WHICHEVER IS GREATER.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for gross negligence, wilful misconduct, death, or personal injury, or non-waivable consumer rights).

11. Indemnification

You agree to defend and hold Arkkeus harmless from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the Services.

12. Changes and termination

We may update these Terms from time to time. If changes are material, we will post a notice on this page and update the "Last updated" date. Continued use of the Services after the changes take effect means you accept them. We may suspend, modify, or discontinue all or part of the Services at any time.

13. Governing law and jurisdiction

These Terms are governed by the laws of Italy. Disputes shall be subject to the exclusive jurisdiction of the competent courts in Italy, except where mandatory consumer-protection rules grant you the right to bring proceedings in the courts of your country of residence.
